Memorandum of instructions for ICAI election 2009 to the central and regional councils

The polling for elections to the Central Council and the Regional Councils of the Institute  will be conducted on 4^th & 5^th December, 2009 at the polling booths located in Ahemdabad, Bangalore, Chennai, Delhi/New Delhi, Hyderabad, Jaipur, Kolkata, Mumbai and Pune and on 5^th December,2009 at the polling booths in the remaining centers.

According to the List of Voters published by the Council, A Chartered Accountant would be entitled to cast a vote at the polling booth assigned to him, according to his address, provided that he satisfies all the conditions specified for the purpose under the provisions of the Chartered Accountant Act, 1949, the Chartered Accountants (Elections to the Council) Rules 2006 and the Chartered Accountants Regulations, 1988.

The polling booth will remain open on the appointed day / days from 8.00 A.M. to 8.00P.M.

A memorandum of instructions as issued by the Institute of Chartered Accountants of India is as follows:-

MEMORANDUM OF INSTRUCTIONS FOR ELECTIONS TO THE CENTRAL AND REGIONAL COUNCILS

1. On entering the polling booth, you should proceed directly to the person in-charge of identification and announce your identity. After your identity has been established, you will be given separate ballot papers for the Central and Regional Council Elections.

2. On receiving the ballot papers, you should forthwith proceed to the Secret Chambers set apart for the purpose of recording the votes.

3. In order to cast your vote :-

(a) You must place on your ballot paper the  number  1 (in Arabic or Roman numerals or in words) in the square opposite the name of the candidate for whom you desire to vote; and

(b) You may, in addition, place on your ballot paper the number 2, or the numbers 2 and 3 or the numbers 2, 3 and 4 and so on (in Arabic or Roman numerals or in words) in the squares opposite the names of other candidates in the constituency in order of your preference up to the maximum numbers of preferences.

(c) You may however put the cross mark, i.e., ‘X’ against whom you do not desire to mention any preference.

4. It may please be noted that aballot paper shall be invalid if : -

(a) a voter signs his name or writes any other word or figure upon it or makes any mark including a tick (? ) Cross (X), not being a mark of ‘X’ put under (c) above, upon  it by which the ballot paper becomes recognizable or by which the voter can be identified; or

(b) it is not printed by or under the authority of the Council or it is different in any manner from the ballot paper printed and supplied to a voter; or

(c) number 1 (in Arabic or Roman numerals or in words) is not marked on it; or

(d) number 1 (in Arabic or Roman numerals or in words) is set opposite the name of more than one candidate; or

(e) number 1 (in Arabic or Roman numerals or in words) and some other numbers are put opposite  the name of the same candidate; or

(f) It is unmarked or the marks made are void or cannot be unambiguously determined; or

(g) It  so damaged or mutilated that its identity as a genuine ballot paper cannot be established.

5. After One have recorded his votes on the ballot papers for the Central and the Regional Council elections, he should fold the two ballot papers separately, leave the Secret Chamber and insert the ballot papers in the SEPARATE ballot boxes provided for the Central and the Regional Council elections, in the presence of polling officer.
